Equion Capital Pty Ltd (ACN 654 046 938) as Trustee for The Equion Capital Trust (ABN 50 442 758 680) trading as Equion Capital is an Authorised Representative (001295172) of Equion Financial Services Pty Ltd (ACN 665 050 297 and AFSL 551814) places great importance on protecting the privacy of its clients.

Equion Capital’s Privacy Policy is designed to ensure adherence to both the letter and spirit of the Privacy Act 1988 (Cth), as amended by the Privacy and Other Legislation Amendment Act 2024 (Cth), and the Australian Privacy Principles.

We recognise that providing personal information is an act of trust and we take that seriously. Unless you directly give us consent to do otherwise, Equion Capital will only collect and use your personal information as set out below.

COLLECTING INFORMATION ABOUT YOU

Equion Capital collects, uses and discloses and holds personal information to perform its functions and duties under the Corporations Act 2001, Anti-Money Laundering and Counter Terrorism Financing Act 2006 and other legislation that prescribes functions or duties on Equion Capital.

Almost all information collected by Equion Capital relates to businesses rather than individuals. However, certain personal information about individuals is collected in the course of providing our services. This information will generally be limited to:

  • Name, position and organisation

  • Contact details, including address, email and telephone number

  • Correspondence and information provided by you

  • Information relevant to transactions, engagements or enquiries

  • Limited website usage data, such as IP address and browser type

USING AND DISCLOSING YOUR PERSONAL INFORMATION

Equion Capital may disclose your personal information to third parties in limited circumstances where you would reasonably expect us to disclose your information. Equion Capital website may contain links to websites operated by third parties. If you access a third party website through our website, personal information may be collected by that third party website. We make no representations or warranties in relation to the privacy practices of any third party provider or website, and we are not responsible for the privacy policies or the content of any third party provider or website. Third party providers or websites are responsible for informing you about their own privacy policy and we recognise you to read their privacy policies.

AUTOMATED DECISION-MAKING

Equion Capital does not use automated tools or systems that make or inform decisions about individuals in connection with client onboarding, screening, relationship management or the delivery of our services. Should this change, we will update this policy to provide appropriate transparency in accordance with our obligations under the Privacy Act 1988 (Cth).

STORAGE AND SECURITY OF PERSONAL INFORMATION

Equion Capital takes reasonable technical and organisational measures to keep secure any information we hold about you. All electronic data is stored on secure servers, protected in controlled facilities, with access limited to authorised personnel. Hard copy documents are generally held on site, in a mixture of locked cabinets and safes, depending on the nature of the document.

We retain personal information only for the duration of your relationship with us, unless we are required to retain your personal information to comply with applicable laws, for example record keeping obligations, after which it is securely destroyed or de-identified.

Equion Capital is the sole owner of all information collected on this website. You acknowledge and consent that any information provided to Equion Capital in connection with the use of this website may be used by Equion Capital for its internal business purposes, including but not limited to marketing, planning, product development and research.

Equion Capital may disclose this information to third parties as reasonably required, including where Equion Capital is required to provide information under any applicable law or in connection with Equion Capital's internal business functions.

OVERSEAS DISCLOSURE

COMPLAINTS AND YOUR RIGHTS

If you have a concern about how your personal information has been handled, please contact us in writing. We will review and respond to your complaint promptly.

We encourage you to raise concerns with us first so that we have the opportunity to resolve the matter directly. However, you are not required to do so, and you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au at any time, whether or not you have raised the matter with us.

You may also have the right to take direct legal action under the statutory tort for serious invasions of privacy introduced by the Privacy and Other Legislation Amendment Act 2024 (Cth), in effect since 10 June 2025. This tort provides individuals with a cause of action where their privacy has been seriously invaded by intrusion upon their seclusion or misuse of their personal information.
